In divorce,
child custody arrangement will be part of the divorce decree. The US Child law
is broad because there is a different child custody law in every state.
Usually,
permanent custody will be given to the parent to whom the child will stay
majority of the time. There are other courts that allow joint physical custody,
where the child will spend equal time with the mother and the father. Split
custody, on the other hand, divides the children to each parent.
The court tries
hard to arrive on a decision that is best for the child. The parent who is
awarded with the custody of the child has the complete control on deciding the
education, health care, and religion of the child or children.
According to the
US child law,
there are two types of child custody: the legal custody where the parent has
the legal power to make important decisions for the child, and the physical
custody, which determines where the child will live majority of the time.
Sole legal
custody and joint legal custody are the two types of legal custody. The prior
gives power to only one parent, while the latter gives legal authority to both
parents.
For physical
custody, there is sole physical custody where the child stays with one parent
while visiting the other parent on a regular basis. Another is the joint
physical custody, where each parent shares equal time with their child.
If you are a
parent, facing a hard child custody case, you must remember the following.
- Find a good trustworthy lawyer that is familiar with child custody cases and the US child law. The lawyer must represent you properly in the case.
- Even if you have a lawyer, you still have to do some research about the case and the laws around it too.
- Be mindful of the things that you do with your ex and your children. Make sure you will not do anything reckless, because the other party’s lawyer is looking for reasons for you to not have custody over your child.
