Why... US Couples Prefer Legal Separation over Divorce..??

Studies show that gen-next couples of United States are more inclined toward legal separation than divorce. Take an example of the state of Colorado where more than 70% couples filed legal separation last year, way more than the previous year.

Experts consider various reasons responsible behind it but the most prominent one is certainly the monitory benefits. Just for an instance, you get far more financial benefits with legal separation US than what you get with a divorce. Most couples thus prefer legal separation to save money – either by filing the agreement themselves or by getting additional financial advantages of being separated instead of divorced.

This has somewhere become a troublesome situation for the attorneys and they have started marketing themselves accordingly. Some of them have started offering a flat fee to review a separation agreement, while some have included legal separation agreement review within their legal service package.

Legal separation US attorneys are yet not out of the game provided that a party who’s applying for legal separation still needs a financial check. There is a big misconception in thousands of minds that legal separation is a profitable method than divorce, but it’s not true in all cases. Some complications may arrive such as:

  • Joint-filing tax benefits:
Different states have different laws for the same, and most of them consider legal separation equal to divorce. In such, the couple does not get the joint-filing tax benefits.

  • Health and social security benefits:
In some cases, separated spouses cannot get the health insurance under their partner’s plan, and same happens with social security benefits. This also varies according to the rules of the state.

Whatever the reason, you still need the consultancy of a skilled attorney to sort things out. Legal separation US has innumerable benefits over divorce but those benefits can only be attained if you have the support of a skilled attorney.
